대구지법 형사6단독 김재호 판사는 무면허 음주운전이 적발되자 동생 신분증을 낸 혐의 등으로 재판에 넘겨진 37살 김 모 씨에게 징역 1년에 집행유예 2년, 사회봉사 80시간을 명령했습니다.
김 씨는 운전면허도 없는 만취 상태서 운전을 하고, 음주 의심 차량 신고를 받고 온 경찰에게 동생 신분증을 내고 수사 관련 서류에 서명한 혐의로 기소됐습니다.
김 판사는 "김 씨가 이미 2차례 음주운전으로 처벌받고 면허가 없는 상태에서 다시 음주운전을 하고, 수사 관련 공문서에 동생 신분을 행사해 죄책이 무겁지만, 교통사고를 유발하지 않았고 어린 자녀를 부양하고 있는 점 등을 고려했다"고 양형 이유를 밝혔습니다.
